- Information provided on this Site is general information only intended to help Queensland homeowners understand building defects, QBCC processes and complaint pathways.

3. Relationship with regulators and other organisations
- QHBA is an independent advisory business. We are not the QBCC (Queensland Building & Construction Commission), QCAT (Queensland Civil and Administrative Tribunal), any court, any government agency or any law firm.
- We are not endorsed by, affiliated with, or acting as agent for any of those bodies, and we do not speak on their behalf.
- Any references on this Site to QBCC, QCAT, government websites or other bodies are for information purposes only. Outcomes of complaints, claims or reviews are determined by those bodies and cannot be guaranteed.
4. Use of the website
You agree not to:
- Misuse the Site
- Interfere with security or functionality
- Upload unlawful, misleading or harmful content
- Use the Site for fraudulent or abusive purposes
We may suspend or restrict access if these Terms are breached.
5. Our Services and Online enquiries
- The Site may allow you to:
- submit an online enquiry
- complete an intake form
- request a call-back or consultation
- book or enquire about one of our QHBA packages.
- Any information we provide in response to an initial enquiry is general in nature unless and until you formally engage us under a separate written Service Agreement / Engagement Letter setting out scope, fees and limitations.
- We may, at our discretion, decline to provide services to you, including where:
- there is a conflict of interest
- your matter falls outside our expertise
- we believe you require legal representation or other specialist advice; or
- it would not be appropriate for us to act.
6. No guarantee of outcome
Building disputes and QBCC/QCAT processes are complex. Many factors outside our control affect outcomes, including builder conduct, evidence available, time limits, statutory requirements and decisions by regulators or tribunals.
- While we aim to provide high-quality, practical guidance, we do not guarantee:
- that any claim, complaint or application will be accepted, successful or decided in your favour
- that any builder, insurer, regulator or tribunal will act in a particular way
- any particular financial or practical outcome.

7. Payments
When purchasing services online, payments may be processed using Stripe, a secure third-party payment provider.
- QHBA does not store your credit card or bank details.
- Stripe handles all payment information in accordance with its global security standards (PCI-DSS).
- By using Stripe, you agree to their terms and privacy policy.
8. Intellectual property
- Unless otherwise stated, all content on the Site (including text, graphics, logos, icons, images, downloads, layout and software) is owned or licensed by QHBA and is protected by Australian and international copyright and other intellectual property laws.
- This does not include:
- Commonwealth or State legislation
- Regulations, statutory instruments, or explanatory materials
- QBCC publications, guidance material, or publicly available government content
- Third-party materials reproduced with permission or under lawful licence
- You may:
- view the Site in your browser
- print or download a single copy of content for your personal, non-commercial use.
- You must not, without our prior written consent:
- copy, reproduce, adapt, publish, upload, transmit or distribute any Site content
- use any QHBA trademark, logo or branding
- create derivative works from our content
- frame or deep link to the Site in a way that misrepresents your relationship with us.

The Site may contain links to third-party websites, tools or resources (for example: QBCC, QCAT, law firms, engineering resources or government sites). These are provided for your convenience only.

10. Limitation of liability
- To the maximum extent permitted by law, QHBA excludes all warranties, guarantees and representations, whether express or implied, in relation to the Site and its content.
- To the maximum extent permitted by law, we are not liable for any loss, damage, cost or expense (including indirect, special or consequential loss, loss of profit or loss of opportunity) arising out of or in connection with:
- your reliance on any information on the Site
- any interruption, delay, error or omission on the Site
- any virus, malicious code or system failure.
- any administrative or procedural actions taken by QHBA as your agent in accordance with your instructions; or
- any outcome determined by a third party, including regulatory authorities.
- If any liability cannot be excluded by law, our liability is limited, at our option, to:
- the re-supply of the relevant service; or
- the cost of having the service re-supplied.
11. Indemnity
You agree to indemnify QHBA, our directors, employees and contractors against any loss, claim or liability arising out of or in connection with:

- your violation of any law or the rights of a third party,
except to the extent caused by our negligence or unlawful act.
